For purposes of this article, illegal drugs include narcotics such as cocaine, methamphetamine, ecstasy, heroin or lysergic acid diethylamide (LSD). For this reason, an individual can be charged with possessing drug paraphernalia even in the absence of any drugs at the arrest scene. This paraphernalia could include any item that would conceivably be used to make, prepare ingredients, measure substances, package or dispense drugs. This equipment could include things like laboratory equipment, scales, capsules or other items. New York State Penal Code § 220.50 states that possession of such equipment constitutes a class A misdemeanor, punishable by up to one year in jail.
