Disability Placard Misuse

When it comes to matters of the penal code, it can be pretty common to get confused by the language of the law. And when you think about it, this makes sense–the laws that are on the books weren’t designed with the average person in mind, but rather for lawyers who have years of experience at interpreting the law and putting it into application. With that said, there are definitely ways to break the law down into easy to manage parts that can then be understood fairly readily. In this post we’re going to take that approach with the charge of Disability Placard Misuse by exploring its definitions, the possible punishments involved, and some defenses that you can put to use for yourself.

Disability Placard Misuse

At its basic level, this charge is all about misusing a disability placard that you might put in your car, which is also known as handicapped parking fraud. This can apply to instances where the lawful holder of one of these placards lends that placard to someone else and/or lets someone else use it with their prior knowledge. This can also apply to someone who’s displaying a disabled placard that wasn’t issued to them, or was revoked or cancelled. This can also apply to someone who’s parked in a spot that’s been designated for disabled people with a vehicle that has a special disabled license plate which was issued to another person. While this covers the misuse of actual disability placards, there’s a whole other section devoted to those placards that are counterfeit as well. As far as punishments go for this charge, you can either be looking at facing a civil fine that would be similar to a parking ticket, so something between two hundred fifty and a thousand dollars. Or you could instead be charged with a misdemeanor for this offense, which would mean that you’d be facing up to six months in county jail, and/or a criminal fine between the amounts of two hundred fifty and one thousand dollars. The final decision will mostly have to do with the severity of the crime, as well as any previous charges that you might have on your record. It’s important also to note that you do have a few options when it comes to potential legal defenses for the charges you might be facing. Let’s take a look at some of those options.


While facing a misdemeanor charge can obviously be a tough thing to do, you do have some options when it comes to possible legal defenses. You can go ahead and claim that you didn’t knowingly allow someone else to use your disability placard, and/or that you were transporting a disabled person at the time.
