Possession of an unlicensed, unloaded firearm, at your home or place of business in New York is considered a misdemeanor, whereas if a loaded and unlicensed firearm is discovered outside of your home or place of business, this is a felony. Assault weapons, regardless if loaded or not or if you have intentions on using it or not, is also a felony.
